One of the states is Maine where a campaign known as Protect Girls in Sports Maine gathered signatures to get this year's vote.
During a recent appearance on "Fox & Friends First," Protect Girls in Sports Maine lead petitioner Leyland Streiff said the organization collected more signatures that necessary.
"Mainers are common sense people," said Streiff. "They understand that males should not be in female spaces, and I think that this is indicative of how the vote will go in November."

A year ago, Maine Gov. Janet Mills openly defied an executive order by President Donald Trump banning biological males from girls sports.
The two of them got into a tense exchange at a governor’s event at the White House days after Trump threatened to withhold federal funding for Maine.
“We’ll see you in court,” Mills told Trump.
Ultimately, funding that had been targeted for withholding was temporarily paused and then restored after legal pushback, rather than being permanently cut off from Maine.
The Maine initiative does need to go through a period of evaluation from the Secretary of State, and Streiff said there is a chance that lawmakers will try to pass their own measure. However, Streiff would prefer lawmakers stay away at this point.
"They have not been able to show up in the past," he said. "We don't want them to. They don't get to claim victory at the end when Mainers showed up and showed what they actually think about this issue. We should allow the democratic process to play out. We should allow this to go to the ballot in November and let Mainers show once and for all they want to protect girls' sports."
Similar measures have been introduced in Colorado, Nevada, and Washington state.
Supporters of males in female sports say it's about inclusivity. However, opponents argue that it's unfair, unsafe, and a violation of a female's Title IX rights to have to compete against males.
For Streiff, it means protection for his daughters.
"I'm a dad of boys and girls, and I want to be able to protect my girl and be able to do what every single dad wants to be able to do … stand up and speak out for their girls," said Streiff.
