The name of the female athlete is not named in the federal lawsuit that was filed Jan. 20 by her mother, Holly Magalengo, who says her daughter was deprived of her “equal protection” rights under the 14th Amendment.
The female athlete, a runner at Quakertown Community High School, lost to the male athlete in two track meets last fall. She finished second behind the teen boy in at least one of them.
The lawsuit names the school district, the Pennsylvania Interscholastic Athletic Association, and the U.S. Department of Education, according to a story by The Philadelphia Inquirer.
The mother and daughter are represented by a well-known Philadelphia attorney, Devon Jacob, and by a Michigan attorney named Solomon Radner.
Matt Lamb, of The College Fix, says the female athlete and her mother now have President Trump and his administration on their side.

"The changes that President Trump is pushing for Title IX will certainly strengthen her case,” he predicts. “And at least there does seem to be cultural backlash against male athletes competing against girls.”
The College Fix reported on the lawsuit in its own story that said the lawsuit, filed two months ago, also named the U.S. Department of Education as a defendant because of the Biden administration’s radical rules on Title IX.
On February 5, however, President Trump signed an executive order banning biological males from competing in women's sports.
