Pro-lifers must unite in face of Wisconsin Supreme Court's abortion decision, life advocate says

A pro-life group has responded after the Wisconsin Supreme Court struck down a 176-year-old abortion ban.

The ban was adopted in 1849, making it illegal for someone to have an abortion other than a mother with a doctor during a medical emergency. With Roe v. Wade in 1973, the ban was nullified. However, many thought it was reactivated once the court case was overturned by the Supreme Court in 2022.

With a 4-3 decision, Wisconsin Supreme Court justices said the ban was superseded by newer state laws regulating the procedure.

Heather Weininger is the executive director of Wisconsin Right to Life.

"I was able to sit in on the oral argument back in November, and it was clear where this case was going to end up for us. They would not enforce the law that has been on the books for so long," says Weininger, "but we're still confused by which law they're referring to and how they came about that decision."

Win or lose, Weininger says pro-life individuals and organizations still need to engage with people to save the life of the child and the mother.

"This isn't going to be won in the courtroom; it's not going to be won at the statehouse. It's going to be us talking one-on-one, changing hearts and minds," says Weininger. "We need to come together stronger than ever before."

Weininger says the law really has not been changed by this decision. Since 2015, Wisconsin has allowed abortions for up to five months and that remains today.

"So, that's why it's so important for us to get active," she says. "Go and talk in your churches, talk in your youth groups, talk in the high schools, and then participate in the elections because they have consequences, especially when it comes to our state supreme court races."
