In addition to requiring insurance companies to ask homeowners and renters whether they own a gun, Assembly Bill 3067 would require them to get "specified information regarding the storage of any firearms kept in the household, accessory structures, or vehicles kept on the property subject to any applicable insurance policy."
Insurers would also be required to annually report this information to the Department of Insurance and to the state legislature.
Alan Gottlieb of the Second Amendment Foundation says this infringes on Second and Fourth Amendment rights.
"The government should have no knowledge of who owns a gun, how it's stored, [or] where it's kept in people's own homes for self-protection," he contends. "This is again a California overreach attacking gun ownership, and quite frankly, the insurance company should be pushing back on it in defense of their client."
If AB 3067 passes and gets enacted into law, Gottlieb's organization will be challenging it in court.
"I would definitely be concerned if I lived in a different blue state than California, because what happens in California tends to go across the country," he notes. "That's why it's important to stop it, and we expect to defeat it in court."
The measure was introduced by Assemblymember Mike Gipson (D). Senator Catherine Blakespear (D) is the principal co-author.
