In September, President Joe Biden previewed his plan forcing private employers to require their workers to either take the COVID injection or be tested weekly – or face penalties of nearly $14,000 per violation. It would apply to companies with 100 or more employees. Today, OSHA (the Occupational Safety and Health Administration) released those requirements, saying the deadline for compliance is January 4, 2022.
The Daily Wire – a media company birthed in the minds of Ben Shapiro and Jeremy Boreing (pictured above) – is making it clear they have no plans to abide by what Boreing calls Biden's "tyrannical" COVID shot mandate.
"… We've sued the Biden administration to put a stop to their gross overreach," said Boreing during a press call Thursday with The Daily Wire's attorneys from Alliance Defending Freedom (ADF) and Dhillon Law Group, Inc. "The president lacks the constitutional authority to force individuals to take this vaccine, so he's trying to use the unelected bureaucrats at the Department of Labor to force private employers to do his dirty work for him. The Daily Wire will not."
Another lawsuit …Job Creators Network (JCN), America's leading small business advocacy organization, also filed a lawsuit Thursday against the Biden administration to block the implementation of its vaccine mandate on small businesses. JCN president and CEO Alfredo Ortiz says the mandate will have "a devastating impact" on the small business community and the entire economy. "The administration's mandate will exacerbate the worst labor shortage in recorded history by requiring small business owners to terminate some employees who wish not to get vaccinated while also shrinking the pool of job applicants available for hiring. Associated staffing shortages will force many of them to reduce capacity and economic output," says Ortiz. "The mandate also adds a new expense for businesses in the form of the costs associated with employee vaccination status tracking and required paid time off for employee vaccination. Employers who don't comply will face significant financial penalties." According to Ortiz, JCN shared these concerns in a meeting with the White House Office of Information and Regulatory Affairs but those concerns went unheeded. |
What The Daily Wire will do, says Boreing, is fight the president's "illegal overreach on both constitutional and administrative grounds."
"Private employers are not the enforcement arm of the federal government," said Boreing. "Forcing Americans to choose between their livelihood and their freedom is a grotesque abuse of power and we won't be a party to it."
Boreing went on to say that The Daily Wire will not incur the cost of implementing this testing regime.
"We will not incur the liability of inserting ourselves into the private health decisions and information of our employees," said Boreing. "Our company was founded to stand against tyranny, and we will."
If you ask Boreing, it is the responsibility of companies and state governments to resist this federal overreach.
"Joe Biden, the federal government, social media, and the establishment media have all conspired to rob Americans of their freedom in the name of public health," Boreing continued. "They've broken faith with the American people through conflicting messaging, false information, and by suppressing data and perspectives with which they disagree. Forcing us to take a vaccine at the risk of financial ruin isn't going to rebuild that lost trust."
Boreing concluded his statement by saying COVID is not the greatest threat that Americans face as a nation. "The coordination between big government, big media, and big tech to erode our liberties is [our greatest threat]," he explained, "and that's what The Daily Wire is committed to fighting against."
The legal challenge was filed today in the U.S. Court of Appeals for the 6th Circuit. The case title is The Daily Wire v. Occupational Safety and Health Administration. The lawsuit takes no position on any COVID-19 "vaccine" or whether any person should make the personal decision to receive it.
